1. Duration and Times of Rental
1.1 Rentals are for a maximum of four weeks and commence on the first day of the Rental Period, unless otherwise notified in writing by Nook and Key Escapes Limited.
1.2 The Rental period cannot be exceeded unless Nook and Key Escapes gives written approval. The customer will be liable for any cost of whatever nature incurred because of an unauthorised extension.
2. Deposit
2.1 If a booking is more than 60 days before the first day of the Rental Period a Booking Deposit plus Booking Fee shall be paid by the Customer at the time they submit the booking to Nook and Key.
2.2 If a booking is less than 60 days before the first day of the Rental Period, the full Rental Fee plus any additional charges must be paid at the time of submitting the booking.
2.3 The Customer’s submission of a booking is an offer to book the Property. If the Property is available on the requested dates, Nook and Key Escapes will send the Customer a Booking Confirmation. At this point a binding contract incorporating these Terms & Conditions will come into existence. Nook and Key Escapes reserves the right to refuse a booking and if Nook and Key refuse a booking, the Deposit, Rental Fees and any additional charges paid by the Customer will be refunded immediately.
3. Final Payment
3.1 Unless otherwise agreed by Nook and Key Escapes in writing, the Rental Fee shall be set out on the website at the time of submitting the booking.
3.2 Subject to Clause 5, as soon as the Booking Confirmation is sent the Customer is responsible for the payment of the balance of Rental Fees in accordance with the clause along with any additional charges such as optional extras.
3.3 Payment of the Rental Fees and additional fees are due 60 days before the first day of the Rental Period and non-payment by the Due Date may be treated as a cancellation.
3.4 If the balance of the Rental Fee is not paid by the Customer on the Due Date, then the Customer will be deemed to have cancelled their booking and Nook and Key Escapes shall retain the Booking Deposit and Booking Fee.
3.5 Nook and Key Escapes shall not be responsible for sending reminders of the Due Date. The Due Date shall be set out on the Booking Confirmation.
4. Changing a Booking
4.1 Once a Booking Confirmation has been sent, the booking can only be changed to another Property by cancelling the original booking in accordance with Clause 5.
4.2 The Rental Period may not be changed by the Customer within 60 days of the first day of the Rental Period. Any other date changes are subject to approval by Nook and Key Escapes and a £38 (including VAT) administration fee will be payable to Nook and Key Escapes.
5. Cancellation
5.1 A booking can only be cancelled prior to the first day of the Rental Period.
5.2 A Customer who wishes to cancel a booking must notify Nook and Key Escapes in writing (“Cancellation Notice”).
5.3 In the event that a Cancellation Notice is received by Nook and Key Escapes, a cancellation charge is payable depending on the number of days before the first day of the Rental Period. Where a Cancellation Notice is received 30 days or more before the first day of the Rental Period, the Booking Deposit and Booking Fee will be payable. Where a Cancellation Notice is received within 30 days of the first day of the Rental Period, the full Rental Fee will be payable.
5.4 Nook and Key Escapes strongly recommends that Customers take out cancellation insurance in relation to their booking.
6. Optional Extras
6.1 If the Property has optional extras, they are listed on the Website or detailed within the Property Guide book within the Property and will be charged at the rates shown.
7. Price Changes
7.1 Nook and Key Escapes reserves the right to amend prices on the Website due to errors or omissions, but such changes shall be notified to the Customer as soon as possible and the Customer shall be able to end the contract if the amended price is significantly higher than the original price quoted.
7.2 If there are any changes in the rate of VAT between the booking and the date of the Booking Confirmation, Nook and Key Escapes will adjust the rate of VAT and the Customer agrees to pay the applicable rate.
8. Method of Payment
8.1 All payments made to Nook and Key Escapes may be made by credit card, debit card or electronic bank transfer.
9. Overseas Bookings
9.1 Customers located outside of the United Kingdom shall pay in Pounds Sterling by Mastercard, Visa, or international bank transfer. Any charges for payments from overseas will be passed on to the Customer.
10. Property Descriptions
10.1 Some of the information on the Website relates to shops, amenities and public houses in the surrounding area. Closures of such premises and other changes to external facilities are outside of Nook and Keys Escapes’ control. If Nook and Key Escapes is aware of any material changes to the Website at the time of the Customer’s booking, then we shall endeavour to inform the Customer of these changes. However, this information is provided for general information purposes and is not intended to amount to advice on which Customers and Guests can rely. Although Nook and Key makes reasonable efforts to ensure the information on the Website is up to date, we make no representations, warranties or guarantees whether express or implied, that the content on the Website is accurate, complete or up to date.
10.2 Properties offering Wi-Fi will have this information detailed in their description on the Website. Provision is subject to availability and network conditions.
11. Previous Websites Terms & Conditions
11.1 The Website and these Terms & Conditions replace and supersede all previous Websites Terms & Conditions.
12. Priority
12.1 If there is any ambiguity or inconsistency between the information on the Website and these Terms & Conditions, these Terms & Conditions shall prevail.
Inventory
12.2 Where Inventory is provided, any discrepancies are to be reported to the Housekeeper within 24 hours of the start of the Rental Period, otherwise the Inventory will be deemed to be correct.
13. Pets
13.1 Pets are only permitted at the Property with the prior written consent of Nook and Key Escapes and are subject to any conditions imposed by Nook and Key Escapes. If Pets are permitted, the Customer agrees that they shall be kept under control and exercised off the premises.
13.2 Pets are not permitted in the bedrooms or on the furniture in the Property and Nook and Key Escapes will not accept responsibility for their safety. Pets must not be left in the Property unsupervised as this can result in considerable damage to the Property and distress to the pet. A Charge will be made for each pet.
13.3 Where the description of the property states “Regret no pets”, or the Property does not accept pets or otherwise restricts the keep of pets at the Property, Nook and Key Escapes cannot guarantee that there have been no pets previously kept at the Property.
14. The Holiday
14.1 The Guest has the right to occupy the property for a holiday only (within the meaning of Schedule 1, Paragraph 9 of the Housing Act 1988).
15. Guest Responsibilities
15.1 Respect for Property: Guests must respect the property and its contents, ensuring no damage is caused. Guests must adhere to all house rules and regulations provided by Nook and Key Escapes.
15.2 Safety: Guests are responsible for ensuring the safety of all occupants during their stay. Any safety concerns or hazards must be reported to Nook and Key Escapes immediately.
16. House Rules
16.1 Noise Levels: Guests must keep noise to a minimum, especially during nighttime hours. Any complaints from neighbours regarding noise may result in penalties.
16.2 Smoking Policy: Smoking is not permitted inside the property. Designated smoking areas outside may be provided. Violation of the smoking policy will result in additional cleaning fees.
16.3 Use of Amenities: Guests must use amenities responsibly and follow any instructions provided. Any damage to amenities will be charged to the guest.
17. Check-In and Check-Out Procedures
17.1 Check-In: Check-in time is from either 3:00 PM or 4:00 PM onwards, as specified in your booking confirmation email. Early check-in may be available upon request. Guests must provide identification and booking confirmation upon arrival.
17.2 Check-Out: Check-out time is by 10:00 AM. Late check-out may incur additional charges. Guests must ensure the property is left in a clean and tidy condition.
18. Insurance
18.1 Travel Insurance: Guests are advised to have travel insurance that covers cancellations, medical emergencies, and property damage. Nook and Key Escapes is not liable for any costs incurred due to lack of insurance.
19. Dispute Resolution
19.1 Mediation: Any disputes between the customer and Nook and Key Escapes will first be attempted to be resolved through mediation. Both parties agree to cooperate in good faith to resolve disputes amicably.
19.2 Arbitration: If mediation fails, disputes will be resolved through arbitration in accordance with the rules of the [Arbitration Association]. The decision of the arbitrator will be final and binding.
20. Privacy Policy
20.1 Data Collection: Nook and Key Escapes collects personal information for booking and communication purposes. Information collected includes name, contact details, and payment information.
20.2 Data Usage: Personal information will be used solely for the purpose of managing bookings and providing services. Information will not be shared with third parties without consent.
20.3 Data Protection: Nook and Key Escapes complies with data protection laws and ensures the security of personal information. Guests have the right to access and request correction of their personal information.
21. Force Majeure
21.1 Definition: Force majeure events include natural disasters, government actions, strikes, and other events beyond the control of Nook and Key Escapes.
21.2 Liability: Nook and Key Escapes is not liable for cancellations or disruptions due to force majeure events. Guests will be notified as soon as possible in the event of a force majeure.
22. Liability
22.1 Accidents and Injuries: Nook and Key Escapes is not liable for any accidents or injuries that occur during the rental period. Guests are advised to take necessary precautions to ensure their safety.
22.2 Loss of Property: Nook and Key Escapes is not liable for any loss of property during the rental period. Guests are responsible for securing their belongings.
23. Amendments to Terms
23.1 Notification: Nook and Key Escapes reserves the right to amend these terms and conditions at any time. Guests will be notified of any changes via email or the website.
23.2 Effective Date: Amendments will take effect immediately upon notification. Continued use of the property after amendments constitutes acceptance of the new terms.
